what would you guys do if you sent someone something and then they claimed it was broke 1 week later they got it? Heres the deal:
sold a novak HV brushless 4400HV on ebay for 180 bucks
dude gets its then 1 week later claims its broken
then claims its my fault
wants refund

then I discuss with him what happened to it he does not say nothing or what happened to it just claimed after, "one weeK' it never worked when he got it and decided to email me about it after one week. I told him that item was tested before I sent it off to him. then he emails back saying he does not know how to set it up how does he set it up. Now he claims he sent it back to Novak to get it fixed.

So should I refund this guy his money back after the so called not working setup when damn sure I tested it before I sent it off it worked like a charm. BTW the guy lives in italy and my 2nd time I had trouble with italians.

I wouldn't refund him. If you tested it before it left your hands, then it either happened in shipping or in his hands. His problem as far as I am concerned. Plus, hjow do you know it doesn't work anyways? He could be scamming you saying it doesn't work, and just wanting his $ back. I have had this happen before too, with a guy I sold a TL01 to. A week after he got it, he put a claim against me in PayPal. I sold the car as is, and aid that in my ad. He got it and said I lied about it's description. I fought it and thankfully it went my way. I just think ebay is loaded with dishonest people any more, and you have to be careful. Again, I don't think I would send any money back unless you can verify that it was broke when you sent it, and you know it wasn't. Good luck. Let us know how it turns out.

B.S.

tell him you want a copy of the R.O. ( repair order) from Novak. If you didnt state a warranty, its his fault he ruined it,...not yours. I know someone who is famous for these actions...

another reason my paypal account is empty. as SOON as money gets transferred, its out of my paypal, and in my checking account. So peopel like him cant take my money, and run with a prefectly good product. It happens more than ya think.

I emailed him just now asking what the invoice said was wrong i told he is going to have to send it back first then I will check that invoice and if its something I didnt do or he did etc...I will refund him his money. I mean novak does not even have the 4400HV anymore and we know here in the states novak upgrades you to 6.5 anyways last time I checked :) well see just annoyned by this guy after having it for one week then claims its broken :roll2:

I agree with Z-Man. Get your money out of your paypal account as soon as you can after a sale.

I also don't think you owe him anything. It worked when you sent it out, you stated that it was being sold in "as is" condition, and if he didn't request insurance it's not your fault if it was damaged during shipping.

I would tell him to go fly a kite!

Did he say if there was any damage to the package when he recieved it? It's possible it could have been damaged in shipping. Even so at worst since he's got it fixed he has a working esc/motor now so all you should have to pay is the cost of repair if it were your fault.

In any eBay auction listing, put the words

"item is used, and sold as-is"

working or not, you are off the hook for any refund or action.

tired of peoplesaying its the buyers fault for something damaged in shipping without insurance, It is the sellers responsabilty to deliver the item working and undamaged. I used too think the same thing tell I lost $400 because I didn't want too spend a extra $5 in shipping. Its was not from paypal but the credit card company that reversed the money and I got educated really quick on whos responability it is for insurance..

so you should quote all items as "shipping including insurance" and add the cost in the listing......

Tell me about it.

I sold a Schumacher Menace 4x4 on ebay as a used RTR truck.

It left me working perfectly. Clean and completly rebuilt.

The guy messaged me to end the auction early. He gave me a nice offer so i did and sent it to him next day delivery.

First he said did you send it insured as he believed it was damaged in delivery. I replyed i have thrown that truck over 10 feet in the air and nothing broke so i doubt it got broken during transport. And asked him to describe the damage.
He didn't describe any damage but just said it didn't work instead.

Then he said parts that i had said were included wernt there. I replyed yes they are and described to him what the parts looked like. He replyed I know what the part looks like.

Then he said the engine wouldnt start. He took it to the hobby shop and they couldnt get i to start. I replyed it shows you how to start it in the manual.

Then he messaged me that he had got the engine started but the truck didn't move, and that he had sent an video of the engine reving but the truck not moving to ebay.
He opened a dispute and wanted a refund. i said he used the product so i won't except a refund.

Seriously anoyed me. And wasn't worth the stress.

In the end he dropped the dispute i got the money and he got the truck.

I think you have to realise anyone can buy stuff off ebay. And as things are sold at a cut price in most cases any Noob might give it a try.
Nothing to complicated about a nitro truck but this guy didn't have a clue.

A brushless system now thats a seriously technical piece of kit i imagine.

The fact that the guy doesn't know how to set it up is one problem. That one point could imply that HE did the damage, and not you or the shipping company (when the phrase "setting it up" is being used, I'm thinking hooking batteries up and what not, not setting the Tx to the ESC). And if he won't show you the repair order from Novak, strike two. The fact that the guy claims it's broken an entire week AFTER he receives it (or so that is how I read it), is bogus. If you receive something that doesn't work, you should immediately report it! Strike three.

I wouldn't refund payment for those reasons. This is why I don't buy, sell, or trade on ebay; I simply have lost faith in the honesty and integrity of people (RCZ...I would still consider, but ebay....no).

I'm glad that the guy I bought my evader diff from didn't screw me over. The majority of ebayers are actually good, but it's always that one lemon that screws everything up........

The only problem I've had was buying a traxxas 2.5 engine that I was going to put in a touring car.

The auction clearly stated, *New, never started*, and appeared so in the pictures. I won the auction, got it shipped.

When I got it, it was coated in dirt, piston was burnt, and the head was discolored, along with a note saying "I put the engine on the truck and broke it in for you so you wouldn't have to worry about it".

I called him out on ebay, and then watched over the course of 2 weeks as every item he sold during that time had a negative feedback on it for similar fraud.

I'm just saying it goes both ways, buying and selling, and that's where feedback history is worth it's weight in gold. Look at both the person's buyer and seller history before agreeing to a deal.

I agree with Z-Man. Get your money out of your paypal account as soon as you can after a sale.

Oh great idea........... then you account can go NEGATIVE and you cannot buy anything until you put the money back IN the account thereby locking your buying capability.

nice idea...... if you have plans to never use paypal again.

HUH? paypal cant take whats not there, if its disputed. What if you just left it all there? I buy a $500 whatever from you, get it, dispute it, get my money back, less paypals fee, and smile, as i made off with YOUR truck for a few bucks......

dude, my money doesnt sit in paypal period.

Paypal does not/cannot go into your private accounts nor "hold" money into the red.... they will simply mark it as "bad feedback".

50 bucks says he plugged the esc into "battery" on the receiver because it's an upgrade from an MSC.

jock- i wouldnt give him his money back!especially after a week after he got it,his loss!

as for ebay i only sell to well established ebay accounts with no recent negative feedback,i cancel "noob" bids cuase i got stiffed to many times.
as for paypal- i heard too many horror stories about it n plus why should i pay someone to collect my money ,yeah sure its conviant but a money order as a payment will be fine for me!

no damage to package nothing mentioned all he said after one week he said it didnt work :( has not emailed me back yet on anything.
